Nothing in this Act shall be construed to modify any other provisions or requirements for a criminal sentencing hearing required by Chapter 10 of Title 10 of the Unified Code of Corrections, relating to community supervision, mandatory minimum sentences, imposition of maximum sentences, or other provisions. (d) On and after January 1, 2026, or during the five years immediately prior to the effective date of this subsection, whichever is later, any person who, under the Sentencing Reform Act of 1984, is sentenced to a term of imprisonment which does not include a term of imprisonment for a violent, first degree murder, first degree sexual abuse, or sexual torture assault, where the sentence does not also include a term of imprisonment for sexual torture or one or more other sexually violent offenses, or second or subsequent sexual abuse offenses, shall not be released from custody until after the expiration of the term of imprisonment imposed pursuant to paragraph (a) of this subdivision. The Secretary of State shall conduct a study, pursuant to Section 11-4.8-3 of this Code, of the impact of this subsection on state fiscal resources.
